This Privacy Policy explains how Aqua Vita Creative (“Aqua Vita Creative,” “we,” “us,” or “our”) collects, uses, and shares information when you visit https://aquavitacreative.com (the “Site”), fill out one of our forms, sign up for text messages, or work with us as a client.

Aqua Vita Creative is a family-owned marketing agency based in Jenks, Oklahoma, serving Tulsa and the surrounding area. Jonathan Cox is our CEO and Creative Director.

Information we collect

Information you give us

  • Contact and Schedule a Call forms. When you fill out a form on the Site, we collect what you enter. This can include your name, email address, phone number, business name, and other details about your business or project. The form also records your IP address and the page you submitted it from.
  • Website Care Plan Contract form. When you sign up for a Website Care plan, we collect your name, business details, contact information, and billing information needed to set up recurring payments. Card payments are processed by Stripe, our main payment processor, and by Authorize.Net, which we still use for some accounts while we phase it out. Your card data is handled by Stripe or Authorize.Net. Aqua Vita Creative does not store your full card number.
  • Text messages. If you opt in to text messages, we collect your mobile phone number and a record of your consent.
  • Emails, calls, and messages. If you contact us directly, we keep the content of that communication and your contact details.

Please do not submit health or medical information through the forms on our Site.

Information collected automatically

When you visit the Site, we and our service providers collect certain information through cookies, pixels, and similar tools. This can include your IP address, browser type, device type, pages you visited, how long you stayed, the site that referred you, and actions you took on the Site, such as submitting a form.

How we use your information

We use information to:

  • Respond to your inquiry and schedule calls.
  • Provide our services, including Website Care, and manage client accounts.
  • Process Website Care payments through Stripe and Authorize.Net.
  • Send you text messages you have agreed to receive (see “Text messaging (SMS)” below).
  • Send you emails about our services, which you can unsubscribe from at any time.
  • Understand how people use the Site so we can improve it.
  • Measure and improve our advertising.
  • Protect the Site and prevent fraud or abuse.
  • Meet legal obligations.

Cookies, analytics, and advertising

We use Google Tag Manager to manage the tools below on the Site.

  • Google Analytics 4. Helps us understand how visitors use the Site, such as which pages they view and how long they stay. Learn more at https://policies.google.com/technologies/partner-sites.
  • Meta (Facebook) Pixel. Helps us measure the results of our Facebook and Instagram ads and show ads to people who have visited the Site.
  • Google Ads conversion tracking. We may use Google Ads tools to measure whether our ads lead to actions on the Site, such as a form submission.
  • HubSpot. Our HubSpot tracking code uses cookies to connect Site visits and form submissions with our contact records.

These providers may collect information about your activity on the Site and on other sites over time. Their use of that information is governed by their own privacy policies.

How to opt out

  • Browser settings. Most browsers let you block or delete cookies. If you block cookies, some parts of the Site may not work as expected.
  • Google. Manage ad personalization at https://adssettings.google.com. You can also install the Google Analytics opt-out browser add-on at https://tools.google.com/dlpage/gaoptout.
  • Meta. Manage your ad preferences at https://www.facebook.com/adpreferences or through your Facebook or Instagram account settings.
  • Industry tools. You can opt out of interest-based ads from many companies at https://optout.aboutads.info and https://optout.networkadvertising.org.

Text messaging (SMS)

If you give us your mobile number and check the box agreeing to receive text messages, Aqua Vita Creative may send you text messages.

  • What we send: Replies to your inquiry, appointment and call scheduling messages and reminders, project and account updates, Website Care notices, billing reminders, and occasional information about our services.
  • Consent: We only send text messages to people who have opted in. Consent to receive text messages is not a condition of buying any product or service.
  • Message frequency: Message frequency varies.
  • Cost: Msg & data rates may apply.
  • Opt out: Reply STOP to any message to stop receiving texts. We will send one message confirming you have been unsubscribed. After that, you will not receive further texts unless you opt in again.
  • Help: Reply HELP for help, or contact us at info@aquavitacreative.com or (918) 518-5907.
  • Carriers: Mobile carriers are not liable for delayed or undelivered messages.

Mobile information will not be shared or sold to third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. We share mobile information only with service providers that help us deliver text messages, such as our messaging platform, and only for that purpose.

How we share information

We do not sell your personal information. We share information only as described here:

  • Service providers. We use companies that help us run our business and the Site, including:
  • SiteGround (website hosting)
  • Gravity Forms (website forms)
  • Stripe (payment processing)
  • Authorize.Net (payment processing, being phased out)
  • HubSpot (CRM and email marketing)
  • HighLevel / LeadConnector (CRM, scheduling, and text messaging)
  • Google (Tag Manager, Analytics, and Ads)
  • Meta (advertising measurement)
  • Sucuri (website security)
  • LiteSpeed Cache (website performance)
  • Legal reasons. We may share information if required by law, or to protect our rights, our clients, or the public.
  • Business changes. If our business is sold or merged, information may transfer to the new owner, who would be bound by this policy for information collected under it.

The SMS restrictions above apply in every case. Mobile numbers and SMS consent are never shared for anyone else’s marketing.

Embedded content from other websites

Pages on the Site may include embedded content such as videos, images, or articles from other websites. Embedded content behaves the same way as if you visited the other website directly. Those websites may collect data about you, use cookies, and track your interaction with the embedded content, including when you have an account and are logged in to that website.

Data retention

We do not have a set time period for deleting information. We keep personal information as long as we need it for the purposes described in this policy, to provide our services, and to meet our legal, tax, accounting, or contractual obligations. When we no longer need it, we delete it or anonymize it. SMS consent and opt-out records are kept as long as needed to honor your choices.

Security

We use reasonable measures to protect your information, including Sucuri website security, encrypted (HTTPS) connections, and payment processors (Stripe and Authorize.Net) that handle card data so we do not store it. No method of transmission or storage is 100% secure, so we cannot guarantee absolute security.

Your choices

  • Email: Use the unsubscribe link in any marketing email.
  • Text messages: Reply STOP to any text.
  • Access, correction, or deletion: Email info@aquavitacreative.com to ask what information we have about you, correct it, or ask us to delete it. We may need to keep some records for legal or billing reasons.
  • Cookies and ads: See “How to opt out” above.

Children’s privacy

The Site and our services are meant for businesses and adults. We do not knowingly collect personal information from children under 13. If you believe a child has given us personal information, contact us and we will delete it.

Links to other websites

The Site may link to other websites. We are not responsible for the privacy practices of those websites. Review their privacy policies before sharing information with them.

Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will change the “Last updated” date at the top. If changes are significant, we may give additional notice on the Site.
